Please take the time to read the waiver below. You/your child will not be able to participate in any equestrian activity at Exhibition Equestrian Rosewood without signing this form.
I, the undersigned, in consideration for being permitted to participate in any equestrian activity, including horse riding, conducted by Exhibition Equestrian Rosewood, understand, acknowledge and accept that:
1. Horse riding is a dangerous activity and horses can act in sudden and unpredictable ways, especially if frightened or hurt.
2. There is a significant risk that serious injury or death may result from horse riding and associated activities and I freely assume all such risks, even if arising from the negligence of Exhibition Equestrian Rosewood, its directors, officers, agents, employees and volunteers.
3. I voluntarily participate at my own risk and assume sole responsibility for any injury, death or property damage I may suffer.
4. It is dangerous to consume alcohol or drugs before participating in any equestrian activity and I agree not to drink alcohol or take drugs prohibited by law or medication that may impede my reactions or motor skills, before or during any equestrian activity conducted by Exhibition Equestrian Rosewood and I take full responsibility for any injury, loss or damage associated with their consumption.
5. I understand that activities conducted by Exhibition Equestrian Rosewood are completed on the premises of a working farm and that there are risks involved in participating in these activities as a result of this. I understand that there are wild animals present (kangaroos, snakes) which may cause serious injury or death.
5. I will follow the directions of the coach(es) of Exhibition Equestrian Rosewood and understand that any misconduct (including causing any danger to a horse, myself, or any other rider a representative of Exhibition Equestrian Rosewood) or refusal by me to follow the directions can result in the cancellation of my participation and my immediate removal from my horse no matter where that may occur. I understand that such non-compliance may result in injury, death and/or permanent disability and I agree to indemnify Exhibition Equestrian Rosewood, its directors, officers, agents and employees, including the coach, against all claims made by any person as a result of my failure to comply with any direction.
6. I agree to wear a helmet at all times whilst participating in an equestrian activity, including horse riding and agree I am solely responsible for my actions.
I have disclosed all medical conditions relevant to my participation in equestrian activities and understand that Exhibition Equestrian Rosewood are not liable for any incidents that may arise as a result of my conditions and participating in equestrian activities.
I, for myself and/or on behalf of my children or next of kin hereby release, indemnify, hold harmless and agree not to sue Exhibition Equestrian Rosewood and its representatives, other participants and owners and licensors of premises used for any activity conducted by Exhibition Equestrian Rosewood (each, an Indemnified Person), in relation to, arising from, or in connection with any and all injury, disability, death or loss or damage to person or property associated with any act or omission of any Indemnified Person, whether caused by the negligence of any Indemnified Person or otherwise.
I, the undersigned, understand, acknowledge and accept that I:
Have provided accurate information regarding medical ailments that may impact my safety or ability when riding
Have had sufficient opportunity to read this Release and Waiver of Liability and Assumption of Risk Agreement;
Fully understand its terms;
Understand that I have given up substantial rights by signing it; and sign it freely and voluntarily, without inducement of any kind.
